General Terms and Conditions of Sale — Fibre Herd Subscriptions and Publication Fees (SaaS)

These terms apply to SaaS subscriptions and to marketplace publication fees (single listing) on the Fibre Herd platform. OFDA analyses and lab shop products remain governed by the terms and conditions of sale of fibrelabandco.com.

1. Purpose

These T&Cs govern, without restriction or reservation:

1. the subscription to and payment of Fibre Herd subscription plans (online software service / SaaS);
2. any payment of marketplace listing publication fees (single listing offer),

concluded under the Fibre Herd brand by Filature de la Vallée des Saules SAS with adult buyers, whether consumers or professionals (hereinafter “the Customer”), on the fibreherd.fr website.

These T&Cs are permanently accessible on the Site. Validation of the subscription / payment constitutes acceptance. The enforceable version is the one online on the date of the order. They prevail over any other document as regards subscriptions and platform publication fees.

The data recorded by Fibre Herd / FVS constitutes proof of the transactions, unless proven otherwise.

2. Subscription plans (prices displayed on the Site are authoritative)

PlanRecord quota (indicative)Indicative price
Free≤ 100 € / year (records, pedigree, Fibre Lab & Co analyses; limited marketplace publication — see Art. 2 bis)
Starter≤ 4019 € / year
Farm≤ 12059 € / year
Prounlimited99 € / year

The exact features of each plan are shown on the Pricing page. The Company may change its offers; ongoing subscriptions are handled in accordance with the terms communicated (reasonable notice).

On the Starter / Farm / Pro plans, publishing marketplace listings is included in the subscription for the animals covered by the plan quota (within the technical limits of the plan).

Each subscription lasts one (1) year from payment, with no automatic renewal (Art. 4). The quota counts the records created, for life: a record whose animal is archived, sold or deceased is still counted and keeps all its data. Paid records (animal record only or single listing) are not counted.

Animal record only: beyond the quota of the Free plan or of the subscribed plan, the Customer may buy an animal record at 1 € TTC per animal, paid once and valid with no time limit for that animal, which then no longer counts towards the quota. It does not include a listing. Grouped payment, minimum order 5 € TTC; unassigned records remain available on the account and are used automatically for the next animals beyond the quota.

2 bis. Free plan listings and marketplace publication fees (single listing)

Free plan: the Customer may publish up to ten (10) free marketplace listings online at the same time (sale, stud service or exchange), each for 90 days, for animals covered by the plan’s record quota. A listing that is withdrawn, sold or reaches its expiry date frees its place; the Customer may then publish a new listing or republish an expired listing free of charge, with no time limit, as long as no more than ten free listings are online at the same time; putting a listing that has not expired back online does not extend its expiry date. Listings published previously and still online, including those without an expiry date, count towards these ten places.

Beyond these ten free listings, for an animal beyond the quota of its plan, or for any user without a subscription entitling them to publish, Fibre Herd offers an alternative without an annual subscription:

This is not a commission on the sale price agreed between breeders: it is a platform service fee for putting the listing online. See also the Marketplace Terms.

Starter / Farm / Pro subscriptions: publishing listings is included in the subscription (Art. 2). On subscription, the Free plan’s free listings that are online become listings included in the subscription, with no expiry date of their own; those for animals beyond the quota of the subscribed plan remain free listings until their expiry date. What happens to listings at the end of the subscription is set out in Art. 4.

3. Order and payment

The sale only becomes final after confirmation of registration (email within 24 hours in principle) and collection of the price (or Free activation). If no email is received, the Customer should contact [email protected].

Payment failure = order / renewal cancelled; paid access or paid publication suspended.

4. Term, renewal, termination

5. Right of withdrawal (consumers)

Consumers in principle have fourteen (14) days to withdraw, without giving any reason, from the conclusion of the digital service contract.

Early performance: if the Customer expressly requests the immediate start of the service and, where applicable, acknowledges losing their right of withdrawal once the service has been fully performed with their prior agreement and express waiver (French Consumer Code, Art. L.221-28), the applicable legal conditions apply.

The right of withdrawal is exercised by an unequivocal statement sent to [email protected], or by using the model form in the appendix. Address: Filature de la Vallée des Saules — Fibre Herd, 20 rue Jean Mermoz, 59227 Saulzoir, France.

Professional customers: no statutory consumer right of withdrawal.

Sums due are refunded within 14 days of the notification, using the same means of payment unless otherwise agreed.

6. Access to the service

Access to the features of the plan is provided after payment (or Free activation). Beyond the plan’s record quota, adding animals is not blocked and no record is deleted: surplus records are kept pending (viewable, not editable, with no listing included in the subscription) until the purchase of an animal record (Art. 2), a single listing (Art. 2 bis) or a higher plan (Art. 4), or until other animals are archived. Reactivating an archived animal is subject to the same quota. Reading and receipt of analyses are retained according to product rules.

In the event of non-payment: access may be suspended after notification.

7. Laboratory analyses (outside the scope of these T&Cs)

OFDA analysis orders and lab products / services are sold exclusively on fibrelabandco.com and are subject to that shop’s terms and conditions of sale. Fibre Herd may facilitate the order (FLID, pre-filled basket, display of results).

8. Legal guarantees

Consumer Customers benefit from the legal guarantees applicable to digital services (conformity) and, where applicable, from the guarantee against hidden defects, independently of any commercial guarantee. The Company does not currently offer any additional commercial guarantee.

9. Liability

Excluded in particular: loss of profits, breeding decisions, disputes between marketplace breeders.

10. Personal data and cookies

Processing is described in the Privacy Policy, which is separate from these T&Cs. Payment: Systempay (Lyra Network), our secure payment provider.
